1. Agreement to Terms

By accessing our website, placing an order, or engaging with our supply and delivery services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use our services or purchase our products.

These Terms apply to all clients, buyers, contractors, site visitors, and others who access or use the products and services provided by EK Onkar Mining & Quarries.

2. Scope of Business

EK Onkar Mining & Quarries operates Zimbabwe's largest single-location crushing plant, powered by Sandvik technology. We directly manufacture and supply top-grade aggregates, including but not limited to Raw stone boulders, Quarry Run/Fill, Crusher Run (0-19mm), Quarry stones, Quarry Dust (5mm, 6.7mm), Granular Sub-Base (GSB), Railway Ballasts, Road Surfacing Stones, and Gabion boxes and stones.

3. Who We Are

EK Onkar Mining & Quarries is based in Zimbabwe. Our office and project operational sites are located at:

• Head Office: 9, Trinity Close, Greendale, Harare, Zimbabwe
• Project Address: Drill Granite Quarry, Gardiner – Arcturus Road, District Goromonzi, Mashonaland East, Zimbabwe

4. Quotations, Orders, and Deliveries

All product quotes, supply agreements, and nationwide delivery arrangements are subject to availability, site accessibility, and confirmed transaction terms:

• Product Specifications: Aggregates are processed using precision crushing equipment. It is the buyer's responsibility to verify that ordered specifications match their specific construction or engineering requirements.
• Nationwide Delivery: Delivery timelines are estimates and depend on site accessibility, offloading conditions, and transport clearances. Offloading sites must be safe and accessible for delivery haulage vehicles.

5. Acceptable Use

You agree not to use our digital platforms, quotes, or services for any unlawful purpose, fraud, misrepresentation, or activities that cause disruption to our quarrying and sales operations.

6. Intellectual Property

All intellectual property, business logos, product specifications, brand names, and website content belonging to EK Onkar Mining & Quarries remain the exclusive property of the company. Sandvik technology references remain the property of their respective trademark holders.

7. Disclaimers and Warranties

THE PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS UNLESS EXPLICITLY GUARANTEED IN WRITING UNDER A SPECIFIC SUPPLY CONTRACT. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, EK ONKAR MINING & QUARRIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

EK Onkar Mining & Quarries shall not be liable for any indirect, incidental, special, or consequential damages resulting from delivery delays, site-access restrictions, or improper site handling of materials once delivered, except as required under mandatory provisions of applicable law.

9. Force Majeure

Neither party shall be held liable for failure or delay in fulfilling supply or delivery obligations where such failure arises from causes beyond reasonable control, including extreme weather conditions, natural disasters, mining equipment breakdown, road closures, civil unrest, or statutory government directives.

10. Governing Law

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of Zimbabwe. Any legal action or dispute arising out of or relating to these Terms shall be subject to the jurisdiction of the competent courts of Zimbabwe.
